These terms and conditions outline the rules and regulations for the use of Platinum NightLiners LTD's Website, located at https://platinumnightliners.com/terms-and-conditions

By accessing this website, we assume you accept these terms and conditions. Do not continue to use Platinum NightLiners if you do not agree to take all of the terms and conditions stated on this page.

Terms & Conditions: Henceforth, The Company means ‘Platinum Nightliners Ltd’

1). Drivers’ hours and rest periods: The current regulations governing drivers’ hours and rest periods must be complied with. A copy of the regulations that came into effect as of April 11th, 2007, have been sent to you with your quote along with the suggested dates and/or places where the drivers need to take their weekly rest periods. Should the driving regulations not be complied with on request or by coercion of the hirer or his/her agent, the Company accepts no responsibility for any loss incurred in the event of enforced roadside breaks and the hirer will be held liable for any penalties incurred at that point or in the event of future prosecution.
Drivers are not to make any changes to the itinerary; the Tour Manager must contact the office for any required amendments.

2). Property, effects and equipment: The Company accepts no responsibility or liability for loss or damage to any property, equipment or personal effects carried or left on the vehicle, except as caused specifically by the Company, driver or mechanical/electrical defect. Door entry fobs will be distributed to clients with a £10 deposit per fob, failure to return these fobs at the end of the tour will result in a non-refund of this deposit.
If Platinum Nightliners are asked to change the keypad code at any time due to the negligence of passengers, we reserve the right to charge for any costs incurred. The supervision, maintenance, conduct, safety and insurance of the hirer(s) and passenger’s property and equipment is not the responsibility of Platinum Nightliners. Any property that is left on the contracted vehicle at the end of a tour will be made available for collection without any costs from delivering or collecting of any items.

3). Payment: All bus hires must be paid in full before the start of the tour; no credit terms are offered. For tours with a value of £5000 or less, these will need to be paid in full before the commencement of the tour. A non-refundable deposit of at least £1000 will be required to confirm any booking and buses will not be deemed booked until the deposit is received. Specific terms will be arranged on tours with a value over £5000 and confirmed in writing at the time of booking. Failure to adhere to the payment schedule may lead to the withdrawal of services.

4). Insurance: Platinum Nightliners advises that the hirer should have appropriate insurance to cover all travel predicaments. It is also advised by the company that the hirer has insurance to protect the tour, cancellation due to poor ticket sales or health issues, to cover baggage loss/damage including equipment, to cover the cost of travel and hotels if a contracted vehicle has a mechanical failure and a substitute vehicle is not available. Platinum Nightliners recommends that EU citizens should always carry an EHIC card (European Health Insurance card) with them. The hirer and passengers should be aware of any changes made in the event of Brexit when travelling to Europe.

5). Cancellation charges: A cancellation charge is applicable if the tour is cancelled.

  • Within four weeks of the commencement of the tour – 50% of the total charge

  • After commencement of tour – 100% of the total charge or at the discretion of The Company.

  • The Company reserves the right to withdraw its services at any time without notice.

6). Breakdown and delay: The Company will not guarantee the completion of any journey within any specific time period and will not be responsible for any revenue loss, consequential loss or inconvenience caused by unplanned delays or accidents affecting the actual journey time. The Company will endeavour to provide suitable comparable alternative travel and/or accommodation arrangements in the event of breakdown whereby the Company cannot replace the vehicle in a reasonable timeframe. Should the hirer decide to make any other arrangements regarding alternative transport or accommodation in the event of a breakdown, they may be liable for the full costs of said arrangement unless specifically agreed with the Company beforehand. Please see the section regarding the driver’s hours and rest periods above in respect of any loss incurred if the driving regulations are not complied with.

7). Parking & parking tickets: The hirer shall be responsible for any parking costs or fines incurred when picking up, dropping off or parking at hotels or venues if no adequate arrangements have been made beforehand. The cost of city permits is also to be borne by the hirer. In the event of parking tickets being issued remotely by the camera with the inevitable delay this entails, we reserve the right to pass these costs onto the hirer at a later date, during or after the hire period.

8). Smoking: As of July 1st, 2007, it will be against the law to smoke in our vehicles, as passenger-carrying vehicles are classified as a workplace.

9). Fuel costs: Should the price of fuel increase by more than 5% in the period between a quote being given by Platinum Nightliners Ltd and the commencement of the hire period, the Company reserves the right to levy a fuel surcharge to cover such an increase.

10). Conduct of Passengers: The driver is responsible for the safety of the vehicle at all times, and as such may remove passengers from the vehicle whose behaviour prejudices the safety or the integrity of the vehicle through malicious damage. The hirer is responsible for any damage caused to the vehicle by any passenger for the duration of the hire.

11). Laundry: All bus laundry costs are to be borne by the hirer on production of receipt by drivers or as part of on-tour laundry arrangements.

12). Driver Buy-Outs: Should the hirer not supply catering on show days, whilst the vehicle is on hire, it is the hirer's responsibility to subsidize the driver’s food costs for that day in the form of a £20 buy-out. This is to be paid directly to the driver in cash during the hire period.

13). Bus wraps: Should the hirer require vehicles to be branded or wrapped, the Company accepts no responsibility for a vehicle change in the event of an accident, damage to the vehicle or mechanical

14). Damage to Vehicles: The Hirer is responsible for any damage caused to the vehicle by any passenger or agent for the duration of the hire. Any damage caused will be billed accordingly to the Hirer.

15). Carnet: The responsibility for the handling, inspection and signing of any ATA carnet lies solely with the tour manager. The company nor its representatives accept no liability for any losses or fees incurred as a result of the failure to correctly process a carnet.

16). Wi-Fi: Unlimited Wi-Fi data is included whilst in the UK. 12Gb fair usage data limit in the EU.

17). Vehicle journeys and movements: All quotations are calculated using the information provided by the hirer. Routes and mileages are calculated on a venue-to-venue basis unless otherwise agreed, and therefore any additional movements to/from parking areas and/or hotels is not included within the quotation and are therefore not permitted without prior approval from Platinum Nightliners. Any vehicle operated by Platinum Nightliners is not to be classed as a taxi or shuttle service between venues and hotels as this is likely to interfere with driver’s legal driving/rest periods. All our vehicles are fitted with a tachograph which records the vehicle and driver movements, and any breach of the rules and regulations could result in prosecution for the driver and/or company. Suitable ground transport should be provided by the hirer at their cost to cover such movements.

18). Vehicle access and parking: It may not be possible to enter a preferred site location due to physical or legal restraints, which can be due to the size of Platinum Nightliners vehicles, especially if a hired trailer is attached. If access is not granted to the desired site, the company does not accept responsibility for any delays or inconvenience caused. If the driver of the contracted vehicle decides that the desired site is not suitable to access or for parking due to the potential damage to the vehicle and/or trailer, the hirer must accept this decision. Any inconvenience or disruption to the schedule will be reduced as much as possible within reason. Whilst on tour, our vehicles require parking with a 32a 3 phase power supply when stopped. If parking with power is not available at any time, then the vehicle must be securely locked, and paid hotel rooms must be provided for the driver and any passengers. This is because without 32a 3 phase power the air-conditioning will not operate, and the vehicles cannot maintain a comfortable living area and are unable to be secured. It is the responsibility of the hirer to organise and pay for all parking, power supply and hotel rooms when applicable.
